"Artificial Intelligence (AI) will replace tasks, not lawyers."

The rapid acceleration of artificial intelligence technology is top of mind for many of us in the legal profession, as it should be. The power of generative artificial intelligence systems is stunning and will significantly impact the way we practice and communicate. OpenAI’s newly released Chat GPT-4 is the first technology to pass both the multiple-choice and the written portions of the Uniform Bar Exam (in the 90th percentile)! Casetext has confirmed that GPT-4 technology powers it CoCounsel legal assistant AI tool. CoCounsel was released publicly on March 1, and is already in use in several firms including those who have been beta-testing it since last fall.

While the excitement about generative-AI technology is contagious, we need to remember that they are just tools and meant to enhance the services we use our education and experience to provide. We must also stay mindful that use of this (or any) technology by attorneys raises a host of ethical, legal, and practical challenges. The dangers of how and whether to leverage artificial intelligence tools in legal practice are evolving as quickly as the technology itself.

The Innovation and Technology in the Legal Profession Committee is following developments in artificial intelligence carefully and will continue to provide a forum for discussion of the implications for our industry.
