Issues and Concerns in Representing the Respondent in Civil Appeals

It is often said that the best way to win an appeal is by winning at trial (in order to avoid being the appellant). This is because a judgment is presumed to be correct. In a standard civil appeal, the appellant has the burden to show why a judgment is erroneous and should be reversed.

September Free Member CLE: Courtroom Security Update
Join the Criminal Law and Trial Sections on Wednesday, September 25, from 11:30 AM to 1:00 PM for an informative CLE session on "Courtroom Security Updates," featuring guest speaker Andrew Lay, Chief Division Counsel for the FBI St. Louis Field Office. Mr. Lay will provide an overview of relevant federal and state criminal statutes commonly applied to courtroom security issues, such as 18 USC § 1503(a) concerning jurors and court officials. He will also discuss publicly available information from recent local cases involving judges.
